What personal data we collect and why we collect it

Collection & Use of Personal Information

AXESS GROUP PTY LTD ACN 069 997 119 (including its related entities within the meaning of the Corporation Act 2001) is committed to protecting your privacy and personal information.

This policy concerns how we may collect, use, disclose and store your personal information, credit information and credit eligibility information. Terms used in this policy have the same meaning as in the Privacy Act 1988, the Australian Privacy Principles (APPs) under that Act and the Privacy (Credit Reporting) Code 2014 (Code).

We will or may collect and store information about:

  • Your name, date of birth and any evidence of identity including telephone number;
  • Loan transaction information, including default information, that we receive as the assignee of your debts or as the mercantile for a creditor to collect a debt you owe to them, they will provide us with personal information about you;
  • The assigned credit account and your repayment history, including payments overdue exceeding $150 for at least 60 days;
  • Information about the payment or discharge of your debt to us;
  • That we are a credit provider to you when we have accepted an assignment of your debt;
  • Your current address and previous address and two prior addresses, last employer, date of birth and drivers licence number; and
  • Information about your credit worthiness as permitted by the Act.

We will also collect information from you and your representatives and, in some circumstances, we will collect sensitive information about your health that may relate to your current financial position but only when you authorise it. We may collect personal information from other parties and publicly available sources, such as the internet and social media.

We will only collect personal information that is related to:

  • Managing the recovery of your loan assigned to us by another credit provider;
  • Managing the recovery of a debt you owe to one or more creditors when we act as their mercantile agent;
  • Providing and maintaining our financial products and services to you including conducting market research;
  • Executing your requests and instructions;
  • To comply with our legal obligations, such as verifying your identity or assessing your capacity to repay loans; and
  • A purpose disclosed to or authorised by you.

If personal information is not provided to us, the performance of our functions as your credit provider or in acting as a mercantile agent for other creditors will be affected.

We can disclose your personal information to:

  • A credit reporting body about a loan or loans you have from us;
  • Lawyers, other mercantile agents, such as process servers and tracing agencies, and professional advisers such as our auditor;
  • Courts;
  • Organisations that verify your identity;
  • Other credit providers and their advisers;
  • Your authorised agents and representatives;
  • Any person, body, or agency (such as a Government Department) where we are required or allowed by law; and
  • Parties outside of Australia if you are located overseas.

Credit Eligibility Information about you

We seek credit eligibility information from credit reporting bodies about you with respect to:

  • Current loans assigned to us;
  • Loan applications by you;
  • Repayment and default history including serious credit infringements;
  • Court Judgments against you and bankruptcy history.

Security & Management of Personal Information

We will take reasonable steps to make sure that the personal information we collect, use, or disclose is accurate, complete, and up-to-date and that it is protected from misuse and loss from unauthorised access, modification or disclosure. We will destroy or de-identify any of your personal information that is no longer required by us.

Access and Correction of your Personal Information

Under the Privacy Act you have the right to request us to provide you with access to your personal information, credit information and credit eligibility information and if any of that information is incorrect you can request that we change it.
